If you need a defective verifying affidavit lawyer at Kibera Kadhis Court, Nairobi, an advocate should review your documents and any deadline. This article analyses Hussein Abdalla Ateib v Josephine Mwikali Mwangangi, explains the court’s decision and identifies practical records to prepare for a review of your situation.

A Nairobi defective verifying affidavit lawyer or advocate should inspect the filed affidavit rather than assume that every pleading defect ends the suit. In Ateib v Mwangangi, the defendant objected that the plaintiff's verifying affidavit was not properly attested or commissioned. The plaintiff sought permission to amend.

The affidavit and the suit had different outcomes

The Kibera Kadhi agreed that the verifying affidavit was faulty and struck it out. The court nevertheless declined to strike out the entire suit. It allowed the plaintiff to amend and file and serve fresh compliant material within seven days. No order as to costs was made.

This was procedural relief, not a final inheritance award. The ruling does not prove that correction was later completed. Nor does the historical seven-day direction create a standard grace period for all present affidavits. A current defect and deadline require review against the actual filed papers and order.

Obtain the filed version

Supply the affidavit as filed and the pleading it was intended to verify. Keep a scan of the complete pages, including the jurat, signature and commissioning area. The adviser needs the document the court received rather than a draft that was later changed.

Identify missing pages or illegible portions in your copy. Do not add a signature or stamp to an existing filed document in an attempt to make it appear complete. The reviewing advocate can examine what is actually on record and assess an appropriate response to the specific problem.

Describe the alleged defect accurately

Provide the objection or application identifying the problem. Mark the passage relied on and explain whether the complaint concerns commissioning, the person swearing, verification or another feature. A general description that an affidavit is invalid may conceal the particular issue needing review.

Include any response already filed. Keep the objection's assertions distinct from a judicial finding. The advocate should be able to see what has been challenged, what is admitted and what remains to be determined, without treating an opponent's description as the operative court ruling.

Trace the filing chronology

List the dates of the original pleading, affidavit, objection and amendment request. Attach filing receipts or court entries available to you. A chronological account can explain whether the immediate task is to respond to a pending objection or comply with an order already made.

Identify hearing notices and deadlines shown in the file. Do not calculate a replacement deadline from this unrelated historical case. The adviser needs the actual direction governing your proceedings, including any later extension or clarification recorded by the court.

Check the scope of permission

If leave to amend or replace material has been granted, supply the order. Identify exactly which document may be changed and what filing and service requirements are stated. Permission concerning one pleading should not be assumed to authorise every proposed change.

Keep the corrected document and its filing record alongside the original. The reviewing advocate can then compare compliance with the direction. The existence of permission is separate from proof that the permitted step was completed within the period and in the manner ordered.

Preserve the service evidence

Provide the record showing delivery of amended or replacement papers. Identify which documents were served and when. A filing receipt alone may not explain the service position where the operative order required both filing and service.

Include correspondence or an affidavit addressing disputed notification. State what is confirmed and what is uncertain. A careful procedural review depends on the complete trail rather than an assumption that the opponent received a document because it appears on the court file.

Keep the substantive dispute separate

Supply the main pleadings and identify the relief ultimately sought. An affidavit ruling may allow a claim to remain pending without deciding ownership, entitlement or distribution. The adviser needs to know whether the enquiry concerns the procedural correction or preparation of the underlying case.

Ateib illustrates the distinction between striking out a faulty affidavit and terminating the whole suit. It does not guarantee permission to correct every defect. A useful Nairobi advocate request includes the filed documents, objection, operative order and evidence of any subsequent compliance.
