If you need a muslim child support order history lawyer at Kibera Kadhis Court, Nairobi, an advocate should review your documents and any deadline. This article analyses R W K v A M A, explains the court’s decision and identifies practical records to prepare for a review of your situation.

A Nairobi Muslim child support lawyer or advocate should read the latest order alongside the initial judgment. The 2015 RWK judgment gave the mother physical custody and the father legal custody, ordered KES 25,000 child maintenance, allocated school fees seventy-five percent to the father and twenty-five percent to the mother, and continued medical cover. It made no costs order.

The trial allocation was subsequently changed

On 13 October 2016, the High Court in RWK v AMA, Civil Appeal 107 of 2015, adjusted maintenance to KES 40,000 monthly. It ordered the father to pay fees at a school agreed by the parties and continue medical cover. Legal and actual custody vested in the mother. Those appellate orders must not be attributed to the Kadhi as its original decision.

Kenya Law's official station index places the 2015 judgment under Kibera Kadhi Court; the mirror's metadata differs. This article follows the official classification and treats the trial allocation as historical, rather than the latest recorded order.

Collect the full order history

Provide the trial judgment, decree, appellate judgment and later orders available to you. Place them in date order and identify which provision each later decision addressed. The adviser needs to know how the operative position developed, not only the first amount appearing in a case report.

Include interim orders if the payment history began before final judgment. An interim direction, trial allocation and appellate variation may explain different periods. Labelling those stages makes it easier to assess compliance without applying one figure indiscriminately to the entire history.

Separate custody from financial terms

Mark the provisions concerning residence, decision-making, contact, monthly support, education and healthcare. Explain which particular provision gives rise to the enquiry. A judgment may contain several directions that were later addressed differently.

Keep the children's current arrangements private and factual. The adviser can compare them with the available orders without assuming that an initial custody label remains unchanged. An account of what the family presently does should be distinguished from what the latest court document directs.

Prepare an accurate payment schedule

List payments with their dates and supporting receipts. Identify whether each amount concerns monthly maintenance, school fees or medical expenditure. Avoid combining different obligations into a single unexplained total when asking whether there is a shortfall.

Show the calculation of any claimed arrears and the order relied on for the relevant period. If the effective date is uncertain, state that for review. A historical variation does not prove what was paid, when a disputed obligation began or what a later enforcement court determined.

Preserve school-related records

Supply fee structures, invoices and the record of the parents' school agreement where relevant. Distinguish a proposed school from one agreed or addressed in an order. The particular wording of the education provision matters to a practical compliance enquiry.

Identify any change of school and the correspondence concerning it. The adviser needs the current records and the available directions. A fee percentage from the trial judgment should not be treated as the final answer after a later appellate order changed the education provision.

Document medical cover and expenses

Provide the available insurance or medical-cover record and any relevant invoice. Explain the particular issue, such as an unpaid expense or uncertainty about cover. Do not infer absence of provision solely because another payment is disputed.

Keep sensitive medical information limited to what is necessary for confidential review. A public article does not need the child's diagnosis or identifying details. The reviewing advocate should be able to evaluate the obligation from the operative order and appropriate supporting material.

Identify the present concern

State whether the task concerns compliance, accounting, a proposed variation or understanding the latest order. Include the hearing notice and any deadline. Explain changes in circumstances with supporting records available rather than assume that a reported amount automatically fits another family's budget.

RWK illustrates why the history of orders matters. The first judgment is useful for understanding the original allocation, while the later appeal materially changed it. A Nairobi advocate needs the current file before advising about the obligation now in issue.
