The appeal changed the medical expenses component
The High Court retained general damages but removed future medical costs because the relief had not been properly pleaded, and reduced special damages to the amount supported by receipts. The resulting award was KSh707,400 after contribution, with trial costs and directed interest; each side bore appeal costs. A narrative interest date conflicts with the trial date elsewhere. The decree and signed orders require checking before calculation.
Separate proposed treatment from expenses already paid
A future medical expenses lawyer needs the medical opinion, proposed treatment plan and supporting cost information. An advocate should know which expenses have already been incurred and which relate to treatment expected later. Keep those amounts separate from general compensation for pain and suffering. Explain who prepared the estimate and when, including whether the proposed treatment or its cost has changed since that assessment.
Gather clinical records, referrals and any updated specialist report available to you. A lawyer should be able to connect the proposed expense to the injury and the medical evidence. Do not treat an online price or an informal estimate as a complete treatment opinion. Mark what remains unavailable and identify requests made to the provider. The consultation should establish which parts of the proposed claim have a reliable evidential basis.
Review what the filed pleading actually asks for
Bring the original plaint, any amended plaint and the filed copies rather than only drafts. An advocate needs to compare the relief requested with the medical material. A figure appearing somewhere in a document may raise a different issue from a clear claim for that relief. Explain any amendment and provide the directions authorising it. The adviser must assess the actual court record before suggesting that the pleading is sufficient.
Keep witness statements and submissions with the pleadings, but do not assume they replace a missing claim. A lawyer needs to identify what was asked for at each stage and whether a correction was sought. If the hearing or judgment has already occurred, disclose that promptly. The available procedural options require assessment of the current stage. A later medical report alone does not necessarily change the relief that was before the court.
Reconcile every receipt with its claimed item
Prepare a ledger of date, provider, purpose and amount paid, with the supporting receipt attached. An advocate needs to distinguish a deposit from a final payment and identify evidence of any remaining balance. Include refunds and payments by another party accurately. A bill showing what was charged is different from proof that the amount was paid. Do not count both a deposit and a total bill as separate expenses without checking.
If a receipt is unclear, preserve it and explain the issue. A lawyer should not have to infer whether a payment relates to the accident from a handwritten total. Identify duplicate records, missing confirmations and disputed charges openly. Keep the calculation reproducible so each amount can be traced to evidence. This helps assess the claim and avoids presenting a larger figure simply because the same transaction appears in several documents.

An advocate needs all reports that were obtained or produced, including an opposing assessment. Note their dates and the condition recorded at each examination. Apparent differences may reflect recovery, different tests or an actual dispute that requires examination. Do not describe a medical conclusion as agreed unless the record supports that statement. Give the lawyer the complete document rather than only a paragraph extracted from it.
Explain current symptoms and treatment accurately, distinguishing your experience from clinical findings. A lawyer can identify which questions require updated medical evidence without replacing the clinician's role. Preserve information about treatment already undertaken and its effect on the proposed future plan. The consultation should assess the medical and financial records together, rather than use an earlier estimate as if it were permanently fixed regardless of later events.
Bring the judgment and calculation to the consultation
Where an award has already been made or appealed, include the judgment, decree and interest account. An advocate needs to see which components were allowed, rejected or altered. Keep contribution, costs and interest separate from the underlying damages. Do not assume that a headline award is the amount currently payable. Payments and subsequent orders may change the balance and need to be disclosed with evidence.
Ask what further documentation would make the proposed treatment expense assessable and how it relates to the existing proceedings. A lawyer can review the pleading, medical estimate and receipts without promising that another court's figure will be repeated. Keep the instructions focused on the specific expense issue and current procedural stage. A transparent bundle should show what you claim, why it is needed, how it is supported and which amounts remain disputed or uncertain.
