Looking for a lawyer or advocate for shoulder injury permanent disability damages appeal at Vihiga Law Courts? This guide explains Macharia v Usayo and the documents to prepare for an independent consultation.

The shoulder injury award survived the appeal

The High Court dismissed the quantum appeal with costs, leaving the trial award of KSh1,200,000 general damages and KSh2,550 special damages undisturbed. Its assessment considered the medical record, functional effects and reported permanent disability. This judgment does not establish a fixed price for a shoulder injury. A different injury, recovery history or evidential record requires its own assessment.

Describe the injury through the clinical record

A shoulder injury damages lawyer needs the treatment notes, imaging, operation records and medical reports. An advocate should be able to distinguish the initial diagnosis from the later assessment of recovery. Keep the complete documents, including dates and recommendations, rather than only a list of symptoms. Explain where treatment took place and identify any missing referral or follow-up record that may affect understanding of the injury.

Bring every medical assessment obtained for the proceedings. A lawyer needs to compare the nature of the injury and the basis of any disability opinion. Different terminology in reports should be examined rather than silently merged into one diagnosis. Mark any disagreement or unclear passage for review. The consultation should rely on recorded findings and the evidence available, without describing an unconfirmed condition as established simply because it supports a larger claim.

Explain functional limitations with concrete examples

An advocate needs an accurate account of how the shoulder or arm affects daily activities. Describe the task, difficulty and period involved, distinguishing temporary restrictions from limitations that remain. Keep supporting work records, treatment recommendations or correspondence available to you. A lawyer should understand what you personally experience while recognising that medical conclusions require appropriate clinical evidence rather than assumptions drawn from a job title.

If employment duties changed, explain what changed and why, with the relevant documents. Do not convert every difficulty into a separate monetary loss without evidence. General damages, specific expenses and a claim concerning earnings require separate assessment. The consultation should identify which issue you actually raise and what material supports it. Disclose improvements as well as persistent problems so the advocate can assess the position on a balanced record.

Check the basis of a permanent disability opinion

Keep the report that states a disability percentage and note when the examination occurred. An advocate needs to know which injury and functional findings support that assessment. A percentage is not a substitute for the full explanation in the report. Provide later treatment or reassessment information that may qualify it. A lawyer should not be asked to calculate compensation from a percentage alone without examining the clinical and litigation record.

Where another doctor disagrees, bring that report too. Explain whether the reports were admitted by consent, supported by testimony or otherwise dealt with during the hearing. The evidential position matters when an award is challenged. Avoid treating the absence of a live medical witness as automatically decisive in every proceeding. The consultation should identify what was before the trial court and how the disputed medical issue was actually addressed.

Read the grounds of a damages appeal carefully

An advocate reviewing a quantum appeal needs the judgment, appeal memorandum and relevant exhibits. Identify the particular finding challenged and the alleged error rather than only saying the amount is too high or too low. A lawyer should be able to connect each concern to the record. Preserve submissions from both sides and any directions affecting the appeal so the present procedural position is clear.

Comparable decisions should be examined for their actual injuries and circumstances. Do not assume that an award for a different fracture determines your shoulder claim. Explain the differences in treatment, recovery and functional effect that matter to your case. The adviser can assess whether the comparison assists without promising interference with the award. Dissatisfaction with a figure requires review of the reasons and evidence, not a calculation based only on another headline amount.

Prepare the financial and procedural account

Keep expenses, receipts, payments and the decree in an indexed bundle. An advocate needs to know which sums were pleaded, proved and awarded, and whether anything has been paid since judgment. Separate costs and interest from damages. If you dispute the current balance, show your calculation with its source. A lawyer should not have to reconstruct it from unrelated messages or totals that combine different components.

Ask what the next step can realistically address on the existing record and what information remains missing. Provide relevant dates promptly and disclose any later order or settlement. The consultation should focus on your injury evidence, the specific challenge to the award and the current court file. It should not assume that the successful defence of another person's award guarantees the same result for a different shoulder injury or a different appeal.
