Court: Environment and Land Court at Nyeri
The dispute
Two parcels previously belonging to the family mother were registered to a son who admitted holding for himself, his brother and another brother family. He resisted transfer to the surviving brother and widow, preferring registration to the brother children and alleging the widow remarried. The widow and brother sought determination by originating summons. The trustee did not testify.
What the Court decided
The Court determined the trust and ordered the two parcels divided into three equal shares for the registered trustee, the brother and the widow, with costs against the trustee. Alleged remarriage was not proved and did not justify the exclusion on this record.

The admitted trust and its actual beneficiaries controlled this result. Equal thirds are case-specific, not a universal inheritance formula. Trust determination under the relevant Order 37 procedure is distinct from adverse possession and a general succession grant application.

Originating Summons to Determine and Terminate an Admitted Family Trust
Use the appropriate Order 37 trust-determination process, actual instrument or admitted arrangement, certified registers, supporting affidavit, all necessary persons and proper service. This is substantive educational wording, not the complete filing pack. A trust summons is distinct from adverse possession. Use the trust limb of Order 37 with the actual instrument and admitted arrangement, supporting affidavit and certified registers. Order 37 rule 7 adverse-possession instructions do not apply.

Trustee Replying Affidavit Proposing Registration to Children — Unsuccessful Position
Complete the deponent identity, authority and actual personal-knowledge or identified-information basis. Index and authenticate genuine exhibits; missing exhibits are not supplied by this text. An affidavit is evidence, not a vehicle for new unpleaded relief or invented expert conclusions. Obtain any required leave for a further affidavit and complete a valid jurat before a competent authorised person. This specimen is unsworn. The source trustee did not testify and the proposed substitution and exclusion failed. This is newly drafted reply wording, not a recovered sworn affidavit.
Widow Witness Statement Opposing Exclusion from an Admitted Land Trust
Use the witness own truthful account, distinguish observed events from named information sources and identify bundle pages and authenticating witnesses. Follow the actual trial or succession witness directions. Additional evidence and statements require any applicable leave. An appeal ordinarily uses the admitted trial record; a new statement cannot be inserted without the proper procedure.
Submissions on Admitted Trust Shares and Unproved Widow Exclusion
Identify pleaded issues, admitted evidence and genuine record pages. Follow directions on length, authorities, filing and service. Submissions do not introduce exhibits or cure missing substantive prayers. Distinguish what a party sought from what the Court ordered, and an unsuccessful historical position from the actual holding.
