REPUBLIC OF KENYA

IN THE ENVIRONMENT AND LAND COURT AT NYERI

ENVIRONMENT AND LAND CASE NO [reference]

[CLAIMANT] v [RESPONDENT]

WRITTEN SUBMISSIONS

1. The pleaded questions concern the admitted family trust and its termination. The Applicants rely on the exact admission and registration record at [pages], rather than on an adverse-possession claim or a general estate-administration petition.

2. The Court should first determine the proved beneficiaries and terms of the trust. The Respondent registered ownership is consistent with trusteeship and does not alone permit substitution of the adult brother children as beneficiaries.

3. The proposed exclusion of the widow requires an identified lawful basis and admissible proof. The source record contained an unproved remarriage allegation; submissions cannot supply the missing witness or document.

4. Equal thirds follow only if supported by this admitted arrangement and evidence. The requested division is not advanced as an automatic rule for every family, marriage or succession configuration.

5. Termination and registration must address the two exact parcels, restrictions, survey, lawful consents and execution of documents. A substitute signature on default requires the proper order and cannot be assumed from a draft.

6. The Applicants seek determination of their proved shares, termination of the trust, appropriate transfer directions and costs. The relief should be confined to the trust questions properly before the Court and all affected persons must be heard.

DATED at [place] on [date]. Signed [party or advocate]. DRAWN AND FILED BY [name and address for service]. TO BE SERVED UPON [each affected person and address].

Educational reconstruction from a reported decision. Newly drafted sample, not an original filing or a matter handled by our team. Identifying details are replaced with bracketed fields. Verify the facts, law, jurisdiction and court directions before use.

Use and evidence notes

Identify pleaded issues, admitted evidence and genuine record pages. Follow directions on length, authorities, filing and service. Submissions do not introduce exhibits or cure missing substantive prayers. Distinguish what a party sought from what the Court ordered, and an unsuccessful historical position from the actual holding.

Supporting material: [date]; [author or custodian]; [description]; [bundle page]; [authenticating witness]; [admission or permission]. Attach genuine records only. This public specimen contains no exhibits, signatures, personal identifiers or sworn declaration.

Source facts and limits of the decision

Two parcels previously belonging to the family mother were registered to a son who admitted holding for himself, his brother and another brother family. He resisted transfer to the surviving brother and widow, preferring registration to the brother children and alleging the widow remarried. The widow and brother sought determination by originating summons. The trustee did not testify.

The Court determined the trust and ordered the two parcels divided into three equal shares for the registered trustee, the brother and the widow, with costs against the trustee. Alleged remarriage was not proved and did not justify the exclusion on this record.

The admitted trust and its actual beneficiaries controlled this result. Equal thirds are case-specific, not a universal inheritance formula. Trust determination under the relevant Order 37 procedure is distinct from adverse possession and a general succession grant application.
