REPUBLIC OF KENYA

IN THE ENVIRONMENT AND LAND COURT AT NYERI

ENVIRONMENT AND LAND CASE NO [reference]

[CLAIMANT] v [RESPONDENT]

WITNESS STATEMENT

1. I am [widow beneficiary]. My relationship to [deceased family member] is established by [genuine records or direct evidence]. I describe the family land dealings within my own knowledge, not a general legal conclusion about all widows.

2. The parcels [A and B] belonged to [family mother] before registration to [trustee]. The arrangement I rely on is [truthful account and source]. I identify any document or witness confirming that the third family interest included my entitlement.

3. The Respondent admits holding land for the family interests but says I should be excluded because of alleged remarriage. My response is [truthful facts]; the alleged event and its claimed evidence must be stated and tested specifically.

4. I identify [actual correspondence, family meeting or record] showing how my interest was treated. I do not present an unverified dowry allegation or family rumour as evidence. Any disputed information is attributed to its source.

5. I seek my proved share directly, subject to lawful subdivision and any existing restrictions. My claim does not ask this land court to administer assets outside the admitted trust or declare an automatic fraction for every succession dispute.

6. I ask that the Court determine the beneficiaries on the actual evidence, terminate the trust where appropriate and give lawful registration directions. All relevant contrary documents and related proceedings are [fully disclosed].

DATED at [place] on [date]. Signed [party or advocate]. DRAWN AND FILED BY [name and address for service]. TO BE SERVED UPON [each affected person and address].

Use and evidence notes

Use the witness own truthful account, distinguish observed events from named information sources and identify bundle pages and authenticating witnesses. Follow the actual trial or succession witness directions. Additional evidence and statements require any applicable leave. An appeal ordinarily uses the admitted trial record; a new statement cannot be inserted without the proper procedure.

Supporting material: [date]; [author or custodian]; [description]; [bundle page]; [authenticating witness]; [admission or permission]. Attach genuine records only. This public specimen contains no exhibits, signatures, personal identifiers or sworn declaration.

Source facts and limits of the decision

Two parcels previously belonging to the family mother were registered to a son who admitted holding for himself, his brother and another brother family. He resisted transfer to the surviving brother and widow, preferring registration to the brother children and alleging the widow remarried. The widow and brother sought determination by originating summons. The trustee did not testify.

The Court determined the trust and ordered the two parcels divided into three equal shares for the registered trustee, the brother and the widow, with costs against the trustee. Alleged remarriage was not proved and did not justify the exclusion on this record.

The admitted trust and its actual beneficiaries controlled this result. Equal thirds are case-specific, not a universal inheritance formula. Trust determination under the relevant Order 37 procedure is distinct from adverse possession and a general succession grant application.
