Looking for a lawyer or advocate for auctioneer proclamation stay and bank guarantee security at Hamisi Law Courts? This guide explains Climax Coaches Ltd v Ehinda & 2 others and the documents to prepare for an independent consultation.

Stay was conditional on security

The High Court granted stay pending appeal subject to KSh300,000 security deposited with the Deputy Registrar within thirty days or an alternative bank guarantee of the same amount. It directed filing of the appeal record and compliance monitoring, reserving application costs to the appeal. The ruling did not reduce the injury award or decide the quantum appeal. Its security options are case-specific conditions, not a universal tariff.

Bring the proclamation and the actual decree

An auctioneer proclamation stay lawyer needs the notices, warrants, decree and judgment together. An advocate should be able to identify the property listed, the party against whom execution proceeds and the claimed balance. Preserve the documents as served, with the date and circumstances of service. Explain whether any goods have already been removed or a sale advertised. Do not rely solely on a telephone description of what the auctioneer intends.

Keep the principal award, interest, costs and execution charges in separate entries. A lawyer needs to compare the amounts demanded with the supporting court documents and payment record. If you dispute ownership of listed goods, identify the documents supporting that position accurately. Different concerns may require different procedural assessment. A request for stay pending your appeal should not silently assume that every objection to attachment is the same issue.

Explain the appeal and the risk of execution

Bring the appeal memorandum and identify the decision being challenged. An advocate needs to understand the actual grounds and the current stage before considering a stay application. Prepare a chronology of judgment, earlier stay, filing and subsequent execution. Include orders that have expired as well as those you believe remain effective. A belief that an appeal is strong is not evidence that execution has already been suspended.

Describe the practical consequences of attachment with supporting information. A lawyer needs specific evidence of the loss or prejudice alleged, rather than a general statement that payment would be inconvenient. Explain any business use of the property and what records substantiate it. Disclose facts that qualify the claimed risk. The consultation should also consider the successful party's interest in the decree, which remains relevant while a challenge is pending.

Assess a genuine security proposal

An advocate needs clear information about the security you can actually provide. If a bank guarantee is being considered, gather the proposed terms, amount, duration and issuing institution's requirements. Keep an expression of willingness separate from an issued guarantee. A lawyer should assess whether the proposed instrument matches the order or relief sought and whether the necessary steps can be completed within the applicable time.

For a deposit, identify the required recipient or account from the exact court direction. Preserve payment confirmation and any acknowledgment. Do not assume that transferring money to a familiar account satisfies a different security condition. If compliance becomes difficult, tell the advocate promptly with supporting records. Advice must address the actual order and current position; another litigant's permitted alternative does not automatically become available in your proceedings.

Keep compliance evidence separate from the request

Bring the sealed stay order, service material and all directions for monitoring. An advocate needs to know what was granted and which conditions remain outstanding. A filed application, a draft order and an operative court order are different documents. Keep them clearly labelled in your bundle. Record how the relevant parties were informed and preserve responses, without treating an informal assurance as equivalent to a court direction.

Where execution continues despite an asserted stay, provide the exact events and documents. A lawyer should assess the terms, service and compliance before advising how to respond. Avoid obstructing the auctioneer on an interpretation you have not checked. Record conversations accurately and preserve written communications. The useful consultation identifies the current order, the action complained of and the evidence needed to evaluate the position responsibly.

Advance the appeal while managing execution

An advocate needs the record of appeal status, registry correspondence and next date. Security and interim protection should not replace preparation of the substantive challenge. Gather the trial evidence and judgment relevant to the grounds raised, particularly where the appeal concerns an award. Explain what documents remain unavailable and the efforts made to obtain them. Keep an indexed list so the adviser can assess the practical next step.

Ask which conditions require immediate attention and what the interim ruling left unresolved. A lawyer can review the appeal, enforcement account and security proposal without promising that the final award will change. Disclose payments, negotiations and any later orders affecting the position. Your instructions should connect the immediate execution risk to a realistic procedural plan, with a verifiable record of compliance and a clear distinction between temporary protection and the outcome of the pending appeal.
