This guide explains In re Estate of Libaba (Deceased) and the documents to prepare for an independent consultation.
Preservation was granted while inheritance issues remained unresolved
The High Court preserved the disputed estate land, restrained burial and other prejudicial dealings pending appeal, directed police supervision and registry monitoring, and required priority pursuit of the revocation proceedings. Costs were reserved to litigation on the merits. The order protected the pending process; it did not revoke the grant, distribute the estate or conclusively establish any party's inheritance share.
Show how the threatened activity affects the estate
An estate land preservation lawyer needs the succession file and reliable information about the proposed activity. Explain exactly what may change, where it will happen and the information supporting that concern. An advocate should be able to distinguish a confirmed arrangement from speculation. Preserve messages, notices and photographs in their original form, with dates and an explanation of who supplied them. Do not alter material to make the situation appear more urgent.
Describe the present use of the land and any existing court directions. A lawyer needs a clear account of occupation, access and changes already made before considering an application. Explain whether the dispute concerns administration among family members, a third party's ownership claim or both. These distinctions affect assessment of the appropriate forum. The presence of land in a succession dispute does not by itself answer every jurisdiction question.
Bring the grant and the pending challenge together
Keep the grant, petition, beneficiary information and revocation application in one indexed bundle. An advocate needs to understand what was disclosed, what is disputed and the stage of the challenge. State your relationship to the deceased and the capacity in which you seek advice. Identify the documents supporting that relationship rather than assuming that a family description alone resolves legal entitlement or priority in administration.
Include responses from the administrator and any directions for hearing the challenge. A lawyer should assess both sides of the record before proposing preservation. Keep an allegation of concealment separate from a judicial finding that concealment occurred. The urgent application may protect the property while those allegations remain contested. A preservation order should not be presented to relatives as a final determination of who owns the estate or who receives a share.
Explain why waiting could change the position
Prepare a dated account of the threatened act and when you learned about it. An advocate considering urgency needs evidence of timing and the practical effect of delay. Identify any scheduled event and the source of that information. Explain why the requested protection addresses the specific risk, rather than asking for restrictions unrelated to the estate. The consultation should also disclose events that reduce or qualify the urgency you describe.
Gather earlier applications and rulings, including a refusal of relief by the originating court. A lawyer needs the actual reasons given and the subsequent procedural steps. Do not leave out an unfavourable decision because you disagree with it. Preserve the record needed to assess an appeal or other available route. A new application requires review of existing proceedings and directions; a case summary cannot substitute for that examination.

If an order has been granted, bring the sealed version and proof of service available to you. An advocate should review whom it binds, which activities it addresses and how long it operates. A statement that the court maintained the status quo may require careful reading of the detailed directions. Keep preservation, compliance monitoring and the underlying inheritance dispute separate when explaining the current position to the family.
Document any suspected breach calmly and accurately. A lawyer needs specific events, dates and evidence before considering a response. Avoid taking possession, blocking access or involving police on assumptions about an order you have not read. Where enforcement or supervision is expressly directed, provide the exact document to the adviser. The appropriate next step depends on the order, its service and the facts rather than a general belief that you won.
Keep the substantive succession proceedings moving
An advocate needs the next hearing date, registry communications and outstanding documents in the revocation file. Preservation should support meaningful determination of the disputed administration rather than become a substitute for it. Identify the witnesses and records required for the underlying challenge. Keep a separate list of urgent compliance issues and substantive inheritance questions so the consultation can address both without confusing their different purposes.
Ask what the interim decision resolved and what still requires evidence. A lawyer can assess whether the current dispute concerns the validity of a grant, inclusion of beneficiaries, administration or distribution. Preserve originals and disclose any later order affecting the position. The useful consultation is built around your actual file, the immediate threat and a realistic plan for completing the pending process, with no assumption that another family's preservation order determines your rights.
