The refund judgment was affirmed
The appeal was dismissed with costs and the trial judgment ordering refund of KSh20,000 with interest and costs was affirmed. The court relied on the written agreement and rejected unsupported attempts to contradict its terms. The reproduction's payment table contains figures and a stated total that do not reconcile. It should not be used as a verified balance or proof that a decree was discharged.
Identify the payment the seller acknowledged
A failed land sale deposit refund lawyer needs the executed agreement and the evidence of each payment. An advocate should compare the amount acknowledged in the agreement with the amount actually transferred. Explain who received the money and whether they acted personally or for someone else. Keep deposit, purchase price, fees and later repayments in separate entries so the adviser can identify the specific sum you seek to recover.
Bring bank confirmations, transaction messages and receipts without editing their descriptions. A lawyer needs to connect each entry to the relevant transaction rather than infer its purpose from a rounded total. If a cash payment has no receipt, identify the available witness or contemporaneous communication accurately. Do not create a substitute receipt or state a disputed payment as admitted. Mark missing records so the consultation can assess how they might be obtained.
Record why the sale did not complete
Prepare a chronology of execution, payments, proposed completion and communications about transfer. An advocate needs to understand which obligation was allegedly unfulfilled and what the agreement actually required. Include any agreed extension or written variation. A complaint that the seller stopped responding is more useful when connected to specific messages, deadlines and documents. Preserve responses that explain or dispute the delay, even when they do not support your position.
Keep requests for completion separate from requests for a refund. A lawyer should assess the remedy against the agreement and the current facts. Explain whether you entered possession, built anything or incurred additional expense, with supporting records. These circumstances may require separate examination and should not be silently folded into the deposit figure. The consultation should identify the actual relief sought rather than assume every failed transaction produces the same remedy.
Address a disputed signature with evidence
If execution is denied, preserve the original document and information about witnesses. An advocate needs to know when and where the agreement was signed, who was present and how each party received a copy. Keep later communications referring to the agreement in their original form. A serious allegation about authenticity requires careful examination; merely calling a document forged does not establish what happened or displace its evidential significance.
Explain any differences between copies and when you first noticed them. A lawyer can assess whether further investigation or expert material is relevant on the available record. Avoid marking, replacing or rewriting the original. If it has already been produced in proceedings, identify the exhibit and any testimony about execution. The consultation should distinguish your personal recollection, another witness's account and conclusions that would require specialist analysis.

Where judgment already exists, bring the decree, interest calculation, costs certificate and payment history. An advocate needs to separate the principal award from additional amounts and establish how payments were credited. A transfer after judgment may affect the outstanding balance without proving that the original claim was unfounded. Identify payments made to the creditor, an advocate or another recipient and preserve evidence of the purpose for each.
Include correspondence acknowledging receipt and any disputed allocation. A lawyer should not rely on an arithmetic total copied from a case report or a message alone. Make a ledger that shows date, recipient, amount, reference and claimed credit, with supporting material behind each line. If execution proceedings have begun, include notices and orders so the adviser can examine the current enforcement position and the evidence relevant to any accounting dispute.
Prepare focused instructions for the next stage
Bring the pleadings, witness statements, judgment and any appeal documents already filed. An advocate needs the actual issues determined and the relief still available for assessment. Explain whether you seek recovery, clarification of the balance, negotiation or advice on an existing challenge. Disclose unfavourable findings and documents. A useful consultation cannot be based only on the facts you hoped the court would accept.
Ask which missing records matter most and how the proposed step relates to the existing case. A lawyer can assess the current forum and procedural position without promising the result of another litigant's appeal. Keep contractual liability, payment accounting and enforcement complaints distinct. Your instructions should state the disputed amount transparently, explain how it was calculated and identify the documents needed to evaluate both the underlying refund claim and any subsequent payment credit.
