In Shem Ogola Okech v Homa Bay County Government, the landowner relied on alleged trespass and damage during a road project. His constitutional petition failed because the court found the complaint insufficiently precise and the requested relief unproved.
The landowner alleged interference during road construction
The petitioner said he owned parcel 343 in West Karachuonyo and that works on the Kanaam–Nyangweso road entered and damaged his property in July 2016. He brought the claim against the county government, the road authority and the contractor.
He sought declarations, protective orders and damages. These were allegations and requested remedies. The fact that a registered owner brought the petition did not establish all the asserted encroachment, responsibility and monetary loss.
The case reached the Homa Bay Environment and Land Court
The petition began in the Homa Bay High Court and was transferred to the Environment and Land Court at Migori in 2019. Following establishment of the Homa Bay Environment and Land Court, it was transferred there in July 2021.
The judgment was delivered at Homa Bay on 28 September 2021. That history explains why this decision belongs with the Homa Bay court’s analyses even though earlier proceedings took place elsewhere. It must not be assigned solely according to an earlier registry location.
A constitutional provision had to be linked to the particular conduct
At paragraphs 35–39, the judge examined the need to state the complaint, constitutional provision and manner of infringement with reasonable precision. The petition invoked property protection under Article 40, but the court found that naming those provisions did not establish the required case.
The judgment also warned against presenting an ordinary civil dispute as constitutional litigation without the necessary foundation. This is the court’s assessment of the pleading before it, rather than a declaration that road-related property disputes can never raise constitutional questions.
The valuation was not a damages award
A valuation report placed the alleged damage at KSh 545,000. The court considered it as evidence, but that figure did not become an award. At paragraphs 40–42, the judge addressed the distinction between asserting a loss and pleading and proving the monetary relief sought.
Special damages needed both an appropriate pleading and proof. The court found those requirements unmet and also found the claims for general damages, declaration, conservatory relief and injunction unproved. A report attached to a petition did not cure the deficiencies identified.

Someone seeking an advocate for road construction damage in Homa Bay should assemble the register, survey plan, project notices and photographs showing the affected location. Record dates, the nature of the works and the basis for identifying who performed or directed them.
For monetary loss, preserve valuation instructions, methodology, invoices and records identifying each damaged feature. An advocate can then examine the appropriate claim and remedy against the particular defendants. A valuation total and a bare assertion of ownership do not answer every element of responsibility.
The petition was dismissed with each party bearing its costs
At paragraphs 43–44, the court dismissed the petition dated 30 January 2018. Each party was directed to bear its own costs. No KSh 545,000 compensation award, injunction or declaration was granted.
The judgment should not be reported as a positive finding that every road activity was lawful or that no physical damage ever occurred. It records failure to establish the pleaded case and relief. For any current dispute, obtain later orders and review the actual evidence rather than assuming the historical result decides another property claim.
