A Homa Bay property advocate or land lawyer reviewing disputed purchase payments needs to establish what evidence was produced at trial and why any document was omitted. In Okemwa v Ogowo, an applicant wanted bank statements, phone screenshots and transfer records added on appeal. The court refused because the evidence had been available earlier and the motion attempted to fill gaps in the trial case.

The proposed evidence predated the trial

The applicant relied on statements covering December 2021 to March 2022, screenshots made in 2022, a transfer recorded in June 2022 and Land Control Board consent dated April 2022. The suit and trial came in 2024.

At paragraph 27, the judge found these materials had been available to the applicant during trial. No satisfactory explanation showed that reasonable diligence could not have obtained them for use then.

An appeal was not an automatic opportunity to repair omissions

At paragraphs 21–24, the court discussed the appellate power to receive additional evidence and the limits identified in the authorities. Relevant and potentially important documents do not qualify merely because a party now wishes to rely on them.

The applicant must address availability, diligence, fairness and whether the request seeks to reconstruct a weak case. At paragraph 28, the court found no explanation for withholding the phone and transfer records. Neither the witness nor the advocate had asked to introduce those documents during trial.

The confidentiality explanation required evidence

The applicant said the former advocates had relied on client confidentiality to avoid producing bank records. The account included transactions involving other clients, so disclosure raised a separate privilege concern.

At paragraphs 29–31, the judge found no demonstrated formal basis for the proposed change in disclosure. There were no supporting requests and permissions showing why records considered confidential at trial could now be used on appeal. The statements were also not certified by the bank as authentic.

The court did not treat a change of advocate as automatically ending privilege. It noted the absence of steps to separate or redact the applicant’s relevant transaction evidence for production at the trial. The practical lesson is to prepare lawful, authenticated evidence early, with review of whose information is included.

Payment proof and privacy must be prepared together

Someone looking for an advocate for disputed land purchase payments in Homa Bay should preserve receipts, transfer confirmations, correspondence and instructions about how the purchase money was handled. Explain which amounts were paid to the vendor and which were held through an advocate.

If a statement includes other clients’ dealings, give it to the reviewing advocate through an appropriate private channel. This decision does not authorise publishing unrelated transactions. The evidence must be considered with the applicable confidentiality, consent and authentication requirements.

The drafting of the motion also concerned the judge

At paragraphs 19–20, the court criticised a request framed merely as permission to file documents. Such wording did not explain the process by which their contents would be tested rather than treated as proven simply through filing.

An evidence application should identify the precise relief and the mechanism for receiving and testing the material. The court nevertheless examined the motion’s substance and found that it failed the additional-evidence requirements.

The motion failed, while the appeal remained pending

At paragraphs 39 and 43, the court limited its ruling to the February 2025 application. It dismissed that motion and ordered the applicant to bear its costs. Directions were given for submissions in the remaining appeal.

This ruling did not finally decide fraud, fix the purchase-price balance or resolve title. Its November 2025 hearing direction was historical; it is not a current appointment. A live review needs the later appellate judgment or orders, if issued.
