This article analyses Mehta v Kenya Commercial Bank Limited & 2 others, decided by Mombasa Court of Appeal.
The auction challenge failed, but the start date changed
The Court of Appeal at Mombasa upheld the mortgage sale and purchaser titles, finding default, service evidence and no proved fraud on this record. It retained KSh 80,000 monthly mesne profits but changed their commencement to 27 November 2019 because interim orders had supported earlier occupation. Apart from that variation, the appeal was dismissed with costs. The decision does not establish the current balance or prove that possession was subsequently handed over.
Reconstruct the mortgage account before challenging sale
A mortgage auction appeal lawyer needs the offer, charge, account statements and repayment evidence. Prepare a dated schedule of instalments due, payments made and arrears asserted. Keep an isolated payment separate from a complete reconciliation of the account. Identify charges or credits disputed and their supporting documents.
Include communications seeking restructuring or time to pay and any response. Explain whether an arrangement was accepted or only proposed. An advocate should assess the account and operative agreement rather than infer that negotiations by themselves stopped the bank's steps.
Examine notice and service documents together
Bring every demand, statutory notice, notification and auction advertisement available. Include envelopes, certificates of posting and the address recorded in the charge. Mark the date and source of each document. A denial of receipt and an objection to the chosen address require a clear supporting account.
Supply any notice of address change and evidence that it reached the relevant recipient. Do not silently substitute your current contact details for the address used at the material time. The lawyer needs to assess service against the instrument, legal requirements and actual evidence in the proceedings.
Separate pleaded fraud from later suspicions
Identify each allegation already pleaded and the evidence supporting it. Keep a complaint about service distinct from a claim about valuation, price or a later transfer. Explain when each concern was discovered and whether it was included in the court record. General suspicion is not an evidential schedule.
For an appeal, provide the pleadings and admitted exhibits rather than only a new narrative of events. An advocate should assess what the trial court was asked to determine and which finding is now challenged. Any proposed additional evidence requires procedural assessment on its own facts.

Collect the advertisement, auction record, memorandum of sale, payment evidence and registered transfer. Identify subsequent transfers separately. A sale, registration and later transfer can occur on different dates. Keep the chronology accurate so your lawyer can assess the specific transaction being challenged.
Bring searches and title documents relevant to the period in dispute. If a restriction or court order was relied on, provide its terms and the date it took effect. Do not assume that a document lodged after an auction necessarily had the same effect before the auction occurred.
Document the legal basis for continued occupation
Supply each interim order affecting possession, with any variation, expiry or discharge. Record occupation and handover dates separately from court dates. The existence of an interim order may matter to a claimed period, but the advocate needs its exact scope and subsequent procedural history.
If occupation charges are sought, identify their start date, monthly rate and supporting rental valuation. Keep contractual rent distinct from a mesne profit claim following disputed possession. Include the pleaded period and judgment so the adviser can assess the calculation against what was actually ordered.
Calculate the present obligation from operative orders
Prepare a ledger showing the ordered rate, applicable period, payments and any later variation. Do not multiply a historical monthly figure to today's date without establishing when possession ended or what subsequent orders changed. Explain contested dates and preserve handover evidence where available.
For lawyer and advocate review at the Court of Appeal at Mombasa of a mortgage auction and occupation dispute originating at Mombasa ELC, submit the account, service record, title chronology and possession orders. State whether you challenge the sale, respond to occupation charges or seek appeal advice. Mehta demonstrates a limited appellate variation on one record; another case requires assessment of its own evidence and procedural position.
