An advocate confirms availability, scope and fees before accepting your matter. If you need help from a tenant fit-out renovation refund lawyer or advocate for a matter connected to Mombasa Court of Appeal, start with the actual orders and documents. This article analyses Yusuf Mohammed Jiwa t/a Jiwa Properties & another v Mwangi & 2 others, decided by Mombasa Court of Appeal.
Renovation expenditure after access was withdrawn
The Court of Appeal at Mombasa dismissed the landlords' appeal with costs. It upheld reimbursement of KSh 997,930.60 for renovations and KSh 270,000 for the deposit. Acceptance of the offer and deposit, the failure to supply a formal lease and acquiescence in the works mattered. Mesne profits were rejected because the prospective tenants were no longer occupying the premises after lockout. This was a commercial fit-out dispute, not a rule that every alteration must be reimbursed.
Identify the agreement before calculating the refund
A tenant fit-out refund lawyer needs the offer letter, acceptance, proposed lease and payment record. Separate the deposit from advance rent and legal fees. Record when each document was received, returned or accepted. If the landlord accepted a late response, preserve the correspondence and evidence of what followed.
Explain whether a formal lease was supplied and signed. Do not treat permission to take measurements, permission to renovate and permission to trade as interchangeable. An advocate needs to understand which promise the parties actually made and what expenditure was incurred in reliance on it.
Reconstruct access and consent to the works
Prepare a chronology showing key handover, contractor attendance, inspections and any objection to the work. Keep messages from the landlord, property manager and architect together. Identify their roles rather than assuming that every person at the building had authority to approve an alteration.
Where approval was oral, record who spoke, when and what was said. Preserve existing plans, photographs and contemporaneous records. If the landlord disputes permission, supply the contrary documents as well. Your lawyer needs the entire exchange to assess conduct and the agreement's approval requirements.
Itemise completed work and materials left behind
Prepare a schedule of labour, materials, professional charges and the part of each item actually installed. Attach invoices, receipts and payment evidence. Explain whether the claimed amount represents purchase cost, the value of improvements or the cost of restoring the premises. Those calculations may answer different questions.
Include available quantity surveyor reports and the instructions given to the surveyor. A competing valuation should identify the items and differences rather than merely provide a lower total. Keep unfinished work and removable equipment separate so the advocate can assess the claim without double counting.

Supply cancellation notices and the date the locks or access arrangements changed. Identify which materials remained on site and whether collection was offered or refused. Preserve an inventory and any handover correspondence. A claim about continuing occupation must be checked against the actual access record.
Describe immediate losses factually. Keep expenditure on improvements distinct from a claim for future business earnings. If a business never opened, explain its preparations and available records. Do not automatically add projected revenue to a refurbishment refund as if both were already established debts.
Review the pleadings and expert evidence together
For proceedings already filed, bring the claim, defence, counterclaim, exhibits and judgment. Mark which expenditure was pleaded and which witness addressed it. The assessment may depend on how the issue was raised and contested, as well as the invoices themselves.
If an appeal is contemplated, identify the precise finding challenged and where the relevant material appears in the trial record. A new spreadsheet prepared after judgment is not the same as evidence admitted at trial. Explain omissions so the advocate can assess the procedural options accurately.
Reconcile the order with subsequent payments
Keep any refund, settlement, interest calculation and later order in a separate ledger. An award is not proof that money has been recovered. Identify the balance sought now and the party against whom the operative order runs. Supply costs documents where costs recovery is also requested.
