This article analyses Tannen Gaceri v Mwanaisha Shariff t/a Shariff And Company Advocates & another, decided by Voi High Court.
The ruling separated payment from disputed costs
Voi High Court directed remittance of Ksh 500,000 in each of two connected compensation files, with specified balances placed in joint fixed deposit accounts pending taxation of advocate-client costs. It directed protection of another balance and left each party to their own application costs. The reproduction varies in the year given for the third trial file, so that reference is qualified. The ruling did not find a criminal offence, fix a universal fee percentage or establish that the directed payments were later made.
Collect the retainer and fee documents
An advocate compensation settlement account unpaid balance lawyer needs the instructions, fee agreement and relevant correspondence. An advocate reviewing the issue should understand what work was authorised and how fees were to be addressed. Supply the complete signed document and any later change. Highlight disputed additions rather than treating them as agreed wording.
Include instructions relating to an appeal or settlement separately. The adviser needs the sequence of representation. A fee calculation appearing in the Tannen Gaceri ruling cannot establish the terms of another client’s retainer or replace examination of what was agreed in the particular matter.
Match the settlement to each court file
Bring judgments, consents and correspondence showing how the claim concluded. Identify the court number and amount for each file. A lawyer needs to distinguish the original award from a later compromise. Where several claims were handled together, retain a separate record for each rather than combine all receipts into an unexplained total.
Supply the documents recording any agreed adjustment during appeal. An advocate can compare the settlement with the judicial record. A lower settlement figure should not automatically be reported as an unexplained deduction where the full documents may disclose a separately disputed compromise.
Reconcile money received and money remitted
Prepare a dated schedule of amounts received for the claim and amounts paid to the client. Attach acknowledgments, transfer records and statements available to you. A lawyer needs to distinguish the compensation, party costs and amounts retained for fees or disbursements. Keep uncertain entries visible for assessment.
Bring the account supplied by the former representative and identify each item disputed. An advocate can examine the difference between the parties’ calculations. Do not present an unverified balance as a judicially established debt merely because it appears in a demand letter or your own schedule.

Supply the signed voucher or acknowledgment, including the file and payment described. Identify the circumstances and correspondence accompanying it. A lawyer needs to assess whether it concerns one receipt, one claim or a wider settlement. A document from one proceeding should not silently be treated as settling every file handled by the same advocate.
Keep any challenge to its wording or understanding separately explained. An advocate can assess the document and surrounding record. The published dispute should not be used to label another representative’s conduct dishonest before the relevant evidence and response have been examined.
Provide taxation and account directions together
Send any bill, assessment proceedings and order requiring payment or protection of a balance. Identify the sums and deadlines actually directed. An advocate needs the current position to assess compliance. An order holding funds pending taxation should be distinguished from a final determination of every disputed fee or balance.
For consultation, send the retainer, settlement papers, payment account and any discharge together. Identify the file reference discrepancies and current court directions. A lawyer and advocate can assess the Voi Law Courts connection and High Court ruling. The Tannen Gaceri decision illustrates a specific accounting and payment arrangement; it does not prove misappropriation, determine your fee agreement or guarantee recovery of a disputed balance.
