If you need help from a voi vehicle financier third party accident indemnity lawyer or advocate for a matter connected to Voi Law Courts, start with the actual orders and documents. This article analyses Royal Hisham (K) Limited v Diamond Trust Bank (K) Ltd & another, decided by Voi High Court.

The financier’s discharge survived the appeal

Voi High Court dismissed the appeal against discharge of the bank from third party proceedings, with costs to the bank. It treated the bank as a financier without possession or control and found its role in obtaining insurance did not create the asserted indemnity. This was separate from the insurer’s coverage dispute. In 2025, the Court of Appeal allowed that separate insurance suit to continue by dismissing a striking-out appeal. Neither result should be presented as a final finding that every accident claim was insured or paid.

Identify the indemnity actually claimed

A vehicle financier third party accident indemnity lawyer needs the third party notice and the relief sought. An advocate should understand whether the claim concerns contribution, reimbursement or another obligation. Supply the supporting application and the proposed third party’s response. A concern about exposure to damages should be distinguished from evidence of the obligation relied upon.

Keep the main claimant’s pleadings available too. The adviser needs to compare the indemnity issue with the underlying action. A party’s involvement in purchasing or financing a vehicle should not automatically be described as acceptance of responsibility for another person’s driving.

Supply the finance and registration documents

Bring the lending or purchase agreement and available ownership records. Identify why each entity’s name appears and who had possession. A lawyer needs evidence of the arrangement at the relevant time. Keep later repayment or release documents separate so they are not assumed to describe the position when the accident occurred.

Include terms concerning use, insurance and security. An advocate can assess their role in the asserted indemnity. Registration may be relevant, but its purpose should be examined through the actual agreement rather than reduced to an assumption that every registered name carries the same operational role.

Document who controlled the vehicle and driver

Supply employment, operating and hire records relevant to the accident date. Identify who instructed the driver and for whose activity the vehicle was used. A lawyer needs the factual relationship underlying the claim. A financier’s financial interest should be distinguished from evidence of participation in the particular journey or operation.

Provide the competing account and any documents challenging it. An advocate can assess the dispute on its record. The Royal Hisham result arose from the arrangement before that court and does not resolve responsibility where another lender or entity performed a materially different role.

Keep insurance acquisition and insurance liability separate

Bring the policy, certificate, proposal and communications about obtaining cover. Identify who was insured and who facilitated the transaction. An advocate needs to examine the actual documents. Assistance from a broker, bank or agent should not be treated as conclusive proof of a contractual indemnity without assessing the particular relationship.

Include any insurer’s refusal and separate declaratory proceedings. A lawyer needs the later record before discussing the current coverage position. An earlier procedural result should not be described as permanent confirmation of cover where further litigation expressly concerns the policy’s interpretation.

Read the discharge order with later proceedings

Supply the trial ruling, appeal judgment and subsequent orders affecting participation. Identify whether a separate case concerns the insurer rather than the financier’s inclusion in the accident action. A lawyer needs the distinct procedural sequences. A common party name does not make every later insurance decision a reversal of the discharge ruling.

For consultation, send the third party notice, finance agreement, operational records and policy documents together. State whether you seek indemnity or oppose inclusion in the claim. A lawyer and advocate can assess the Voi Law Courts connection and Voi High Court decision. The Royal Hisham judgment records one financier’s discharge; it does not guarantee another bank’s exclusion, settle policy interpretation or determine compensation in the underlying accident claim.
