If you need help from a voi shop rental deposit refund under a written agreement lawyer or advocate for a matter connected to Voi Law Courts, start with the actual orders and documents. This article analyses Ngari v Mwamburi alias Kadogo & another, decided by Voi High Court.

The appeal replaced dismissal with a deposit refund

Voi High Court allowed the tenant’s appeal from Voi PMCC 11/2020 and awarded Ksh 30,000, suit costs and interest from filing until payment. The respondent was directed to pay appeal costs. The court relied on the written agreement’s acknowledgment of payment and found no evidence of default or a quit notice. This was a shop tenancy dispute on its own record. The judgment did not establish that every deposit is refundable regardless of the agreement, payments or condition of another rented property.

Start with the agreement and its payment acknowledgment

A shop rental deposit refund written agreement lawyer needs the complete tenancy document and attachments. An advocate should identify the commencement date, rent, deposit and acknowledgment of payment. Include signatures and any agent’s authority documents available. A clause recording payment can be relevant even where the parties disagree about whether a separate receipt was issued.

Supply later changes to the terms and the correspondence recording them. The adviser needs the arrangement governing the particular tenancy. Do not assume that an amendment discussed informally was accepted or that a clause from another landlord’s agreement describes the obligation in your own file.

Keep rent and the deposit in separate accounts

List payments by date, amount and purpose. Attach receipts, transfer records and relevant messages. A lawyer needs to distinguish the initial security from rent for each period. Identify any disputed allocation rather than silently treating money retained by the landlord as payment for a particular month.

Provide the landlord’s account as well as your own calculation. An advocate can assess the disagreement through both sets of records. If the agreement restricts use of the deposit, highlight the actual wording. Avoid assuming that every deposit can be converted into rent or that conversion is impossible under all tenancy terms.

Document notice and the end of occupation

Bring termination correspondence, delivery records and the date possession was returned. A lawyer needs the sequence of notice, vacating and handover. Identify whether the landlord accepted keys and whether a later inspection occurred. Keep your assertion about termination separate from any disputed factual account given by the other side.

Supply a quit notice or other notice relied upon by the landlord, if one exists. An advocate can compare it with the agreement and payment position. The absence of a notice found in Ngari should not be assumed in another dispute before the actual communications have been checked.

Itemise any reason given for withholding the deposit

Provide the landlord’s demand or refusal and identify each deduction. Attach inspection records, photographs and correspondence concerning the alleged condition of the premises. An advocate needs the factual basis for each item, rather than an unexplained statement that the whole deposit was forfeited.

Keep disagreements about arrears, notice and damage separately described. A lawyer can assess each through its documents. Avoid combining several allegations into one deduction without showing how the landlord calculated it or whether the tenant accepts any part of the claimed amount.

Compare a decided claim with the trial record

If proceedings have occurred, send the pleadings, exhibits, hearing record and judgment. Identify the payment finding or clause you say was overlooked. A lawyer needs the evidence available to the court rather than only a fresh explanation of the transaction after judgment. Include any appeal and later order.

For consultation, send the agreement, separate rent and deposit accounts, termination notice and refusal to refund together. State whether you seek recovery, dispute deductions or review a judgment. A lawyer and advocate can assess the Voi Law Courts connection and Voi High Court appeal. The Ngari judgment records recovery of a particular rental security; it does not guarantee your refund, calculate your arrears or determine responsibility for damage in another tenancy.
